An ex-policeman who is alleged to have been beaten to death with his own baton was found in a pool of blood by his son, a court heard.

John Mackie, 33, whose address was given as c/o Barlinnie Prison, is on trial at the High Court in Glasgow accused of murdering former Merseyside officer Mike Mosey, 58.

In court Mr Mosey's son Daniel, 29, from Forth, said he went to his dad's house at Carnwath Road, Braehead, Forth, Lanarkshire after picking up the phone at 2am to hear moaning and his dad's dogs barking.

In the kitchen he found his dad face down near the cooker which was covered in blood. Daniel said he asked his dad what had happened.

He added: "He rolled over and said Jock Mackie kicked the s**t out of me'.

"I phoned my sister Rachael and told her dad had told me what had happened.

"I bent down, put the phone to his mouth, and asked him to repeat what he had said.

"He said Jock Mackie did it'."

Carstairs man John Johnstone, 34, admitted that Mackie arrived at his door early in the morning and through the letterbox told him: "I have hit old Mick Mosey. I hit him with a police baton."

Andrew Mackie, 31, from Forth, said his brother arrived at his house after 4am, his eyes bloodshot from crying.

He told him Mick Mosey had hit him with his baton and he had hit him back.
