A DRINK-driver who ploughed into a Basingstoke mum has lost an appeal against her jail sentence.

Agnieszka Chrzaszcz was nearly five times over the drink-drive limit in September last year when she reversed at speed into Laura Percival, trapping her against her own front door.

The 28-year-old, of Worting Road, was jailed for three years in April this year at Winchester Crown Court, having admitted causing serious injury by dangerous driving and also driving with excess alcohol.

The Polish-born mother-of-one appealed against her sentence, but Appeal Court judges have now ruled that her punishment, while tough, was not “manifestly excessive”.

The appeal court heard the incident happened on Thursday, September 5, while Chrzaszcz was picking up her son from Winklebury Infant School.

She was seen to reverse her Honda Civic before losing control, smashing into cars before heading towards Mrs Percival, who was carrying her young daughter Freya as she left her home in Willougby Way, Winklebury.

Mrs Percival managed to throw Freya to safety moments before she was pinned against her front door.

The mum was left with four spinal fractures, a crushed pelvis and a ruptured bladder.

The court heard Chrzaszcz gave a reading of 392 milligrammes of alcohol per 100 millilitres of blood, more than two hours after the crash took place. The legal limit is 80mg.

Louise Howard, representing Chrzaszcz, claimed Judge Keith Cutler failed to properly weigh in the balance of all her mitigation, before fixing a final sentence that was too long.

Lord Justice Davis, sitting with Mrs Justice Andrews and Sir Colin Mackay, accepted the sentence may well be considered “severe”.

“However,” he added, “we are not persuaded that it can be styled as manifestly excessive and, accordingly, this renewed application is refused.”

Mrs Percival did not attend the hearing, fearing it would be difficult in her wheelchair, but her husband Gary did.

She told The Gazette: “When I first found out she was going to appeal I was quite angry, because they were making out she was so remorseful. For her to appeal, to me, that’s not remorseful.

“I am happy she did not have anything taken off her sentence.”

Mrs Percival said that doctors believe she will never fully recover from her injuries.

She is due to have a CT scan at the end of November to examine the state of her pelvis.
