Rooksdown man lured teenage schoolgirl into sexual relationship

AN INTIMIDATING young man lured a 14-year-old Basingstoke schoolgirl into a sexual relationship.
Winchester Crown Court heard that Phillip Kapszul, of Penny Black Lane, Rooksdown, had regular intercourse with the girl during six weeks in November and December of 2008, when he was aged 19.
Kapszul, now 23, was in court to be sentenced, having been convicted of sexual activity with a child by a jury in August. Prosecutor Christopher Stopa said that the girl, who cannot be named for legal reasons, would pretend to go to school but then make her way to Kapszul’s home.
Mr Stopa said: “She would put on her school uniform so her parents thought everything was normal. She would then put on a hooded top to go over to his house. They would have sex a couple of times a day for six weeks.”
Mr Stopa said Kapszul and the girl became friends in September 2008, and then after he took her on a trip to Reading, she started missing lessons to see him. Police were made aware of the relationship at the time and arrested Kapszul in 2009 after the couple had broken up, but took no further action.
It was not until January 2011 that the police revisited the matter, when the victim reported that other schoolgirls were visiting Kapszul’s home address, the court heard. Kapszul was then charged and put on trial.
Russell Pyne, defending, said Kapszul had since married, and his wife, who was in the court, was expecting their first child in January next year.
He added: “The defendant has moved on with his life to a considerable extent and now has a stability that he did not have before.”
Having reviewed the evidence from the trial, Judge Keith Cutler sentenced him to 12 months imprisonment, suspended for two years. The judge said: “You were forceful, you were at times intimidating, and at times aggressive in your relationship with her.
“At the time, it had such an impact that her schooling, lessons and examinations clearly suffered, as well as her relationships with her friends and family.”
Kapszul was made to sign on to the sexual offenders register for 10 years and will be subject to a sexual offences prevention order for five years.
